1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the HaulGuardr driver verification platform and related services (collectively, the "Service") provided by HaulGuardr ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
2. Description of Service
HaulGuardr provides a driver verification and proof capture platform designed for freight operations. The Service enables:
- Driver identity verification through photo documentation
- Checkpoint-based location proximity verification at pickup and delivery
- Photo proof capture of documents including BOL, equipment, and POD
- Generation of verification status and evidence packages
Important: HaulGuardr is a verification tool and does not guarantee the prevention of fraud. The Service provides information to help you make informed decisions about your freight operations.
3. User Accounts
3.1 Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Submit false or fraudulent information
- Attempt to circumvent verification requirements
- Interfere with or disrupt the Service or its servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to facilitate freight fraud or theft
- Share account credentials with unauthorized parties

5. Verification Process
5.1 Verification Requests
Freight brokers, shippers, and carriers may create verification requests for loads. Drivers receive verification links and are asked to complete checkpoint requirements including photo submissions and location confirmation.
5.2 Location Verification
The Service uses checkpoint-only location verification. Location access is requested only during active verification steps and is not continuous. By using the Service, you consent to this location verification process.
5.3 Verification Status
Verification results (PASS, FLAG, FAIL) are based on the information submitted and the verification criteria configured. These results are informational and do not constitute a guarantee or warranty about any driver or carrier.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, available at /privacy. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Load Guardr and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THAT VERIFICATION WILL PREVENT ALL FRAUD OR THAT ALL INFORMATION SUBMITTED THROUGH THE SERVICE IS ACCURATE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAULGUARDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless HaulGuardr, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
